All agreements relating to the teaching of the Course by Sport Kidz and Katie Neve to the students are subject to these Terms to the exclusion of all other terms and conditions.

 

No variation or addition to the Terms shall be binding unless agreed in writing by Sport Kidz/Katie Neve and the Parent/Guardian.
 

The Terms shall be deemed to have been accepted by the Parent/Guardian upon payment of the Fee by or on behalf of the Parent/Guardian.
 

The Parent/Guardian shall pay the whole Registration Fee to Sport Kidz/Katie Neve prior to the student beginning the program.

 

The Registration Fee is non-refundable under any circumstances whatsoever except with the prior written agreement of Sport Kidz/Katie Neve, unless the child has attended the first class of their course and given notice that they will not be continuing to attend classes within 24 hours of attending the first class, in which case the course fees will be refunded in full within 30 days.

 

If classes are cancelled as a result of an “Act of God” (e.g. disruption resulting from extreme weather conditions, earthquakes, etc), strikes, terrorist activity, or where local authorities/public guidance advise that classes should be temporarily suspended for health or other reasons, then no refunds will be given and it will not be permitted to defer classes during the affected period.

 

Sport Kidz/Katie Neve may cancel this contract at any time before the student commences the class for any reason whatsoever (including but not limited to the lack of enrollment to fill the classes). Sport Kidz/Katie Neve shall not be liable for any loss or damage whatsoever arising from such cancellation.

 

In the event of cancellation by Sport Kidz/Katie Neve prior to the commencement of the classes by the student, Sport Kidz/Katie Neve will refund any fees for outstanding classes within 30 days.

Sport Kidz/Katie Neve may cancel a certain class throughout the term of the contract for unforeseen reasons (such as but not limited to, the rented space being needed for another event such as a funeral). Upon cancellation Sport Kidz/Katie Neve will immediately reschedule a “make-up” class to be held at the end of the session.

 

The Parent/Guardian warrants and represents that:

a. The information set out in the Registration Form (whether or not completed and/or signed by the Parent/Guardian) is accurate in all respects and the Parent/Guardian will notify Sport Kidz/Katie Neve of any change in such information immediately.

 

b. When attending the classes, neither the student nor the Parent/Guardian will be suffering from any contagious illness, disease or anything similar thereto.
 

c. The Parent/Guardian acknowledges and agrees that the student shall be deemed to be under the direction, care and control of the Parent/Guardian throughout the classes and the Parent/Guardian shall be responsible for the welfare and conduct of the student throughout the class and whilst the student is on the premises where the class is being held.

 

d. The Parent/Guardian shall indemnify and keep indemnified Sport Kidz/Katie Neve against all loss (including loss of profit), liability, costs and expenses which Sport Kidz/Katie Neve shall incur directly or indirectly as a consequence of any action or inaction of the Parent, the Guardian or the Student.

 

 

In the event that Sport Kidz/Katie Neve determines the behavior of the student and/or the Parent/Guardian to be unacceptable, Sport Kidz/Katie Neve shall be entitled to exclude the student and the Parent/Guardian (or either of them) from the classes and the Premises permanently or for such period as Sport Kidz/Katie Neve shall (in its entire discretion) determine.

 

The standard of behavior which is to be regarded as unacceptable at a class or on the Premises shall be determined by Sport Kidz/Katie Neve.
